Intellectual Property
Mr. Henderson registers trademarks both domestically with the United States Patent and Trademark Office (USPTO) and internationally through the World Intellectual Property Institute (WIPO).  Mr. Henderson represents clients before the Trademark Trial and Appeal Board in trademark disputes.  He also represents clients in federal court in disputes under the Lanham Act, which governs trademark infringement, trademark dilution, false advertising, and cybersquatting.  Cybersquatting, also known as cyberpiracy, has become a common problem with the growth of top-level domain availability, and Mr. Henderson has successfully represented clients in protecting their domain names.  Mr. Henderson recently assisted a multi-national client in obtaining injunctions against a competitor for trade dress and trademark infringement.  Mr. Henderson also represents clients in numerous state and common-law issues that arise with trademark infringement and related claims.

Mr. Henderson registers copyrights with United States Copyright Office for various works of authorship.  Mr. Henderson also represents clients in disputes over royalties and copyright infringement.  He recently represented a recording artist and record label in obtaining royalties from an online music provider for the unlicensed digital distribution of recordings through Apple iTunes and other internet music retailers.

Mr. Henderson also works with clients in licensing intellectual property, recently participating as a speaker for Georgia Tech's Enterprise Innovation Institute to a group of inventors on patent licensing.

Perhaps most importantly, Mr. Henderson works with clients to develop cohesive plans to protect and manage their intellectual property, combining trademarks, patents, copyrights, and/or trade secrets to maximize their value to the clients.

Construction
Mr. Henderson represents owners, developers, contractors, subcontractors, and suppliers in construction disputes.  He has successfully represented clients in arbitration and state and federal courts.  His practice ranges from liens to breaches of contract in complex design-build systems.  His experience as a civil engineer provides him with a unique ability to understand and apply the law to the difficult facts that are often prevalent in construction cases.

Healthcare
Mr. Henderson represents clients in the healthcare industry in numerous ways.  He has represented clients in claims under the False Claims Act.  He has also analyzed proposed transactions for Stark and Anti-kickback violations, as well as antitrust implications.  He has advised clients regarding HIPAA compliance.  He has assisted clients in developing institutional Intellectual Property policies and drafting Material Transfer Agreements.  He has also represented physician practice groups in litigation disputes involving claims related to employment agreements and defamation.

Mr. Henderson received his Bachelor of Science degree in Civil Engineering from Auburn University in 1995. He practiced consulting engineering in Atlanta, Georgia and Birmingham, Alabama from 1996 through 1998. He attended the University of Alabama School of Law, where he was a member of the Alabama Law Review, and received his Juris Doctor, cum laude, in 2001.  After graduating from law school, Mr. Henderson clerked for The Honorable Ira DeMent in the Middle District of Alabama from 2001-2002.  Mr. Henderson has been with Hunter Maclean since 2002.
