Experience

• Performance of HIPAA data breach risk assessments and investigations.
• Advise clients on HIPAA regulatory obligations, including audit trail and audit log requirements, corrective actions, and reporting HIPAA breaches to the United States Department of Health and Human Services, Office of Inspector General (“HHS-OIG”).
• Review of contractual arrangements involving the use or dissemination of protected health information (“PHI”) for compliance with HIPAA and other state and federal privacy requirements.
• Preparation of privacy, security and breach notification policies and business associate agreements (“BAAs”) for healthcare providers and business associates
• HIPAA (including HITECH) compliance and development of business associate agreements
• Represented providers, business associates, and other covered entities in OCR investigations for alleged HIPAA privacy and security violations.
